DUI Pre-Trial Diversion

Many times we unintentionally make a bad choice to drive after having a few drinks without thinking about the possible repercussions. Next thing you know you get pulled over and charged with DUI. Fortunately, if this is your first criminal offense we may be able to get your charges dismissed by getting you into a pre-trial diversion program.

If you are a first-time offender you may be eligible for PTD or a pre-trial diversion program. When you successful complete this program your DUI charges are dismissed. The PTD program usually takes 9 months to a year and is strictly supervised by pre-trial diversion officers. As part of the program, you will be required to undergo an alcohol evaluation and any recommended treatment, driver’s education course(s) and community service hours.

Qualifying Factors for Pre-Trial Diversion Program

There are numerous factors which go into determining if you qualify for PTD. These criteria are always changing depending on the jurisdiction of your offense but generally you will only be permitted in such a program if you have no prior criminal history and the DUI does not involve property damage or injury. There are some exceptions to the rule so contact a DUI attorney immediately to find out if you qualify.

Whether you qualify for a pre-trial diversion program or not, the decision ultimately rests with the State Attorney’s Office or the Prosecutor.
