Arrested for a DUI? What You Should Know About Your DMV Hearing

January 9, 2018
By The Wiseman Law Firm

If you’ve been arrested for a DUI in Florida, you need to act immediately to protect your driver’s license. You have 10 days after your arrest to request a formal review hearing to contest the administrative suspension of your driver’s license. If you do not fight this suspension, you will lose your driver’s license, even if you win your criminal trial.

What Happens at a DMV Hearing?

A formal review hearing is not a criminal hearing, but it is still highly important to your case. This administrative hearing is held by the Florida DMV and provides you with a chance to defend your driver’s license and your driving record.

Because this is a formal review, you are able to bring witnesses and evidence to support your claims. Your DUI lawyer can also perform cross-examinations and collect information that can be used to plan your DUI defense. The process is somewhat similar to a criminal trial, but your case is judged by a hearing officer, rather than a judge and jury.

How to Request a Formal Hearing

Because of the short amount of time you have to request a hearing, it is critical to contact a qualified DUI attorney immediately and begin the process of requesting a DMV hearing.

You will need to submit your request in writing. Your request must include your name, driver’s license number, and date of birth. It should also include a statement of the date of suspension and county where you received the notice of suspension of your driver’s license. Your request must be postmarked or filed with the appropriate clerk during the 10-day period following the date you received notice of suspension. You can request a formal or an informal review after you have submitted a hearing request. Your lawyer can help you prepare your request and choose the best hearing type for your case.
